DMCA Policy
1.Overview
SM Calculators Ltd ("SM Calculators," "we," "us," or "our") respects the intellectual property rights of others and expects users of our platform to do the same. This DMCA Policy sets out our procedures for handling claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and applicable law in other jurisdictions including the UK Copyright, Designs and Patents Act 1988 (CDPA) and the EU Directive on Copyright in the Digital Single Market.
SM Calculators hosts user-submitted content (including guest blog articles and tool submissions) and AI-generated content in addition to our own original content. We take copyright claims seriously and have a designated agent to receive notices of claimed infringement.
2.How to Report Infringement

3.Notice Requirements
To be valid under the DMCA, your written takedown notice must include all of the following elements (17 U.S.C. § 512(c)(3)):
- 1. Identification of the copyrighted work: Describe the copyrighted work you claim has been infringed. If multiple works are covered, provide a representative list.
- 2. Identification of the infringing material: Provide the exact URL(s) on smcalc.com where the infringing content appears. General descriptions are not sufficient — we need precise links to locate and remove the material.
- 3. Your contact information: Your full name, mailing address, telephone number and email address.
- 4. Statement of good faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law.
- 5. Statement of accuracy: A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorised to act on their behalf.
- 6. Physical or electronic signature: Your physical or electronic signature.
4.Counter-Notice Procedure
If content you submitted to SM Calculators has been removed following a DMCA notice and you believe the removal was made in error or based on a misidentification, you may submit a Counter-Notice to our DMCA Agent at legal@smcalc.com.
4.1 Counter-Notice Requirements
A valid counter-notice must include:
- Your full name, mailing address, telephone number and email address.
- Identification of the material that was removed and the location where it appeared before removal (URL).
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which SM Calculators may be found, and that you will accept service of process from the complainant or their agent.
- Your physical or electronic signature.
4.2 Process Following Counter-Notice
Upon receipt of a valid counter-notice, we will: (a) provide a copy of the counter-notice to the original complainant; and (b) restore the removed content within 10–14 business days unless the original complainant files a court action seeking to restrain the re-posting and notifies us accordingly.
5.Repeat Infringer Policy
In accordance with the DMCA and our commitment to respecting intellectual property, SM Calculators has adopted a repeat infringer policy. Users who are the subject of three or more valid DMCA takedown notices within any 12-month period will have their accounts terminated and be permanently banned from submitting content to SM Calculators. We reserve the right to terminate accounts of repeat infringers at our sole discretion.
6.Good Faith & Misuse
Our DMCA process exists to protect legitimate copyright holders. We take the following positions seriously:
- Fair use / Fair dealing: Not all use of copyrighted material constitutes infringement. Uses for criticism, comment, news reporting, teaching, scholarship and research may qualify as fair use (US) or fair dealing (UK/Commonwealth). We consider these defences when evaluating notices.
- Abuse of DMCA process: We will not tolerate the use of DMCA notices as a tool to censor lawful content, suppress criticism or engage in anticompetitive behaviour. Abusive notices may be publicly disclosed and/or referred to appropriate authorities.
- Section 512(f) liability: Anyone who knowingly makes material misrepresentations in a DMCA notice or counter-notice may be liable for damages, including costs and legal fees incurred by SM Calculators or the affected party.
7.Disclaimers
SM Calculators is a platform that hosts tool listings, blog content and user submissions. We are not the author or publisher of all content on our platform. We qualify for the DMCA "safe harbour" provisions under 17 U.S.C. § 512 as a service provider that: (a) does not have actual knowledge of infringing content; (b) acts expeditiously to remove content upon receiving valid notice; and (c) does not financially benefit directly from infringing activity over which it has control.
